Mortgagors' tenants get 2 months

Limited protection for tenants in mortgage possession cases coming soon

 

With the coming into force on 1st October 2010 of the Mortgage Repossessions (Protection of Tenants etc) Act 2010 the court will have the power, on the application of a mortgagor's unauthorised tenant in proceedings brought by the mortgagee, to postpone the date for delivery of possession or for execution of a warrant of possession of a dwelling-house for a period not exceeding two months.  For full details of the Act click here.
