Alternative Dispute Resolution

"[ADR] is a relatively new form of justice, which, when compared with traditional litigation (like equity, particularly in its early days) involves far greater procedural flexibility and a far greater range of remedies than formal adjudication. As a result, it is, in many cases, better able to achieve a just or fair outcome for the parties, provided that they both have the will to settle their differences. Fair here not because the outcome necessarily reflects the substantive legal merits of the underlying dispute but rather because the parties have both participated in a consensual process and reached a mutually agreeable resolution. It is a justice not based on a commitment to substantive justice’s achievement."
